Welcome to NorthBite, a food ordering and delivery platform operated by NorthBite Inc. (“NorthBite,” “we,” “our,” or “us”). By accessing or using the NorthBite website, mobile application, or services, you agree to be bound by these Terms of Service.

1. Eligibility

Users must be at least 18 years old or have the consent of a parent or legal guardian to use the Platform.

2. Services

NorthBite provides an online marketplace that connects customers with participating restaurants and independent delivery drivers. NorthBite is not a restaurant and does not prepare food.

3. Account Registration

Users are responsible for maintaining accurate account information and safeguarding their login credentials.

4. Orders and Payments

All prices displayed on the Platform are subject to change. By placing an order, you authorize NorthBite to charge your selected payment method for the total amount due, including applicable taxes, service fees, and delivery fees.

5. Cancellations and Refunds

Refund requests will be assessed according to the NorthBite Refund Policy. Approved refunds may be issued to the original payment method.

6. User Conduct

Users agree not to:

  • Provide false information.
  • Engage in fraudulent activity.
  • Abuse restaurants, drivers, or customer support personnel.
  • Use the Platform for unlawful purposes.

7. Intellectual Property

All trademarks, logos, software, content, and materials on the Platform are the property of NorthBite Inc. and may not be used without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, NorthBite shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the Platform.

9. Indemnification

Users agree to indemnify and hold harmless NorthBite Inc., its officers, employees, and affiliates from claims resulting from misuse of the Platform.

10. Termination

NorthBite reserves the right to suspend or terminate user accounts for violations of these Terms.

11. Governing Law

These Terms shall be governed by the laws of the Province of Alberta and the laws of Canada applicable therein.
